Terms of Service

These terms govern your use of crypticallife.com and any purchase you make here. By using the site or creating an account, you agree to them. If you don't agree, please don't use the site.

Your account

• You must be at least 13 years old to create an account, and at least 18 (or have a parent's permission) to make a purchase.
• Keep your login details private. You are responsible for everything done through your account. Tell us right away if you think it has been accessed without your permission.
• Give us accurate information and keep it up to date, especially your email and shipping address - we use them to deliver what you buy.
• If you sign in with Google, your use of Google is also subject to Google's own terms.

Orders and payment

• All prices are in US dollars. We may change prices at any time, but changes won't affect an order you have already placed.
• Payment is processed by Square. Your order is confirmed only once Square reports the payment as complete.
• We may cancel or refuse an order - for example if an item is out of stock, a price was listed in error, or we suspect fraud. If we cancel a paid order, we will refund it in full.
• Digital items are delivered to your account page immediately after payment. Physical items are shipped to the address on your order.

Digital photography and licenses

• When you buy a photo or photo pack you are buying a license to use it, not ownership of the image. CrypticalLife keeps the copyright.
• A 1-year license lets you download and use the image for one year from purchase. A permanent license has no expiry.
• Licenses are for your personal use. You may not resell, redistribute, sublicense, or offer the images (or anything substantially made from them) for download or sale, and you may not use them in a way that suggests we endorse you or your business.
• Licenses are tied to your account and can't be transferred to someone else.

Returns and refunds

• Digital purchases are final once the download or license has been made available to you, except where a refund is required by law or the item is defective.
• Physical items can be returned within 30 days of delivery if they are unused and in original condition. Contact us first at the address below to arrange a return; return shipping is your responsibility unless the item was damaged or wrong.
• Refunds go back to the original payment method through Square.

Discount codes and the partner program

• Discount codes may have conditions (expiry, minimum order, physical-only or digital-only) and one code can be used per order. We may withdraw a code at any time.
• Partners are approved by us and receive a personal discount code. Partners earn a commission on completed orders that use their code, as described on their partner dashboard, and may spend their balance as store credit on this site.
• Partners may not use their own code on their own orders, create fake orders, or misrepresent their relationship with CrypticalLife. We may adjust or reverse commission on refunded or fraudulent orders, and may remove partners who abuse the program.
• Cash payouts are made at our discretion and recorded on the partner dashboard. Balances have no cash value outside the program until paid out.

Reviews and content you post

• You may leave one review per product you have bought. Keep it honest, your own, and free of anything unlawful, hateful, or that infringes someone else's rights.
• By posting a review or photo you give us a non-exclusive, royalty-free license to display it on the site. We may edit or remove content that breaks these terms.

Acceptable use

Don't attempt to break into, overload, scrape, or interfere with the site, other people's accounts, or our payment or partner systems; don't use the site for anything unlawful. We may suspend or close accounts that do.

Our content

Everything on the site - photographs, designs, logos, text, and code - belongs to CrypticalLife or its licensors and is protected by copyright and trademark law. Apart from the license that comes with a purchase, you may not copy or use it without our written permission.

Disclaimers and limitation of liability

The site and its content are provided "as is". To the fullest extent the law allows, we make no warranties about the site being uninterrupted or error-free, and we are not liable for indirect, incidental, or consequential damages arising from your use of the site. Our total liability for any claim relating to a purchase is limited to the amount you paid for that purchase. Nothing in these terms limits rights you have under law that can't be waived.

Changes

We may update these terms from time to time. The date at the top shows the current version. Continuing to use the site after a change means you accept it.

Governing law

These terms are governed by the laws of the State of California, USA, without regard to its conflict-of-law rules.
